TERMS & CONDITIONS

1.0 Agreement

This Agreement is made between the Client ("the Client") and Training by Francesca ("the Trainer").

By signing this Agreement, the Client confirms that they have read, understood, and agree to be bound by the following Terms and Conditions.

 

2.0 Services

2.1 Clients are required to agree to these Terms and Conditions before participating in any training programme.

2.2 All training sessions require active participation from both the owner and their dog. Where appropriate, certain exercises may require Francesca to work with the dog on a one-to-one basis.

2.3 The initial behavioural assessment is divided into two parts. The first half is conducted with the owner present, while the second half may involve Francesca working independently with the dog. This enables an accurate assessment of whether the presenting behaviours stem primarily from the dog's emotional state or are influenced by owner interactions, handling techniques, behavioural patterns, or anxiety.

2.4 Clients are expected to follow the guidance provided during training sessions. Training by Francesca reserves the right to terminate the agreement where a client repeatedly refuses to follow agreed training guidance, behaves in a disruptive or abusive manner, or prevents sessions from being carried out safely and effectively.

2.5 Engaging another dog trainer or behaviour professional during an active training programme without prior discussion may compromise the consistency of training. Training by Francesca therefore reserves the right to terminate the agreement where conflicting advice is likely to affect the training programme.

2.6 Behavioural training sessions are approximately 55 minutes unless otherwise agreed. Whilst every effort is made to arrive on time, clients are asked to allow for delays of up to 15 minutes on rare occasions due to public transport or unforeseen travel disruption.

2.7 Puppy training packages operate as training credits and must be used within the package validity period (3, 6 or 12 months, depending on the package purchased). Sessions do not need to be taken weekly, and flexibility may improve outcomes. Extensions may be granted at the Trainer's discretion in exceptional circumstances.

2.8 Behavioural training programmes expire after three months of purchase. Weekly sessions are strongly recommended to maintain consistency and progress.

2.9 Standard training treats, including liver bites, chicken, cheddar cheese and sausage, may be used during sessions. It is the Client's responsibility to notify the Trainer of any allergies, sensitivities or dietary restrictions before training begins.

 

3.0 Owner Commitment

3.1 Clients are expected to remain fully engaged throughout each session. Mobile phone use should be limited to genuine emergencies.

3.2 Behavioural modification requires consistency and repetition. Clients acknowledge that meaningful progress is unlikely to occur in a single session, and behavioural cases require a minimum initial commitment of three sessions.

3.3 Clients are welcome to discuss alternative training methods before a session begins. Repeated insistence on using methods that conflict with the agreed training programme may result in the Trainer terminating the agreement.

3.4 Any rude, abusive, aggressive, threatening or inappropriate behaviour towards the Trainer will result in immediate termination of services without refund.

3.5 Clients are responsible for asking questions and seeking clarification during or immediately after sessions. The Trainer cannot accept responsibility for misunderstandings or incorrect application of training advice after the session has concluded.

3.6 In very limited circumstances, and only where appropriate following behavioural assessment, a slip lead may be incorporated into the training programme as part of a balanced training approach.

3.7 Sessions may be postponed if a dog is unwell, injured, in pain or otherwise unsuitable for training.

3.8 The Trainer cannot be held responsible for allergic reactions where the Client has failed to disclose relevant medical or dietary information before training.

3.9 Flexi-leads are not permitted during training sessions. Dogs must wear a secure, correctly fitted collar or harness together with a legally compliant ID tag. The Client remains responsible for ensuring all equipment is safe and correctly fitted.

 

4.0 Payment

4.1 Sessions are confirmed only upon receipt of payment by bank transfer unless otherwise agreed.

4.2 Clients are expected to arrive promptly. Arrivals more than 15 minutes late may need to be rescheduled at the Trainer's discretion.

4.3 Once a training session has taken place, that session is non-refundable.

4.4 Payments are generally non-refundable once made. Refund requests will only be considered where required under applicable consumer law or in exceptional circumstances, such as serious illness or injury affecting the dog, supported by appropriate veterinary evidence.

 

5.0 Cancellation Policy

5.1 Clients may reschedule one appointment with at least 48 hours' notice without penalty. Subsequent cancellations or rescheduled appointments may incur the full session fee.

5.2 Cancellations made with less than 48 hours' notice will be charged at the full session fee.

5.3 Clients arriving more than 20 minutes late may be considered to have missed their appointment and may be charged in full.

5.4 Repeated cancellations or rescheduling (normally more than three occasions) may result in the termination of the training agreement.

 

6.0 Weather Policy

6.1 Outdoor sessions will be rescheduled if temperatures exceed 23°C (or 20°C for brachycephalic breeds). Sessions may also be postponed during moderate or heavy rain where weather conditions are likely to negatively affect the dog's concentration, welfare or safety.

Weather-related decisions are made solely by Training by Francesca, with the welfare of the dogs as the overriding priority, and are final.

 

7.0 Liability

7.1 Dog behaviour is influenced by many factors beyond the Trainer's control. Whilst every effort is made to achieve positive results, no guarantees regarding behavioural outcomes can be given.

7.2 Participation in dog training involves inherent risks, including injury to dogs, owners, the Trainer or third parties. The Client acknowledges and accepts these risks.

7.3 The Client accepts full responsibility for their dog's behaviour during and following training sessions. Training by Francesca shall not be liable for injury, damage, loss or claims arising from the actions of the Client's dog, including bites, scratches, property damage or injury to third parties.

7.4 In the event of an emergency requiring veterinary treatment, every reasonable effort will be made to contact the Client. If the Client cannot be reached, the Trainer is authorised to seek emergency veterinary treatment at the Client's expense.

7.5 Clients are strongly encouraged to maintain appropriate pet insurance together with third-party liability insurance throughout the training programme.

7.6 Nothing within these Terms and Conditions excludes or limits liability where such liability cannot legally be excluded under the laws of England and Wales.

 

8.0 Children & Other Dogs

8.1 Children under the age of 10 may only attend training sessions with the prior agreement of the Trainer.

 

9.0 Aggression Cases

9.1 Dogs with any history of aggression or biting must be disclosed before training commences.

9.2 Where instructed by the Trainer, aggressive dogs must wear a suitable muzzle and/or remain on a secure lead throughout training. Responsibility for the dog's behaviour remains with the Client.

 

10.0 Marketing & Social Media

10.1 Photographs and video footage may occasionally be taken during training sessions for marketing purposes, including use on the Training by Francesca website and social media platforms.

10.2 By signing this Agreement, the Client consents to this use unless they withdraw consent in writing before any images or videos are published.

 

11.0 Session Recording

11.1 Clients may not audio or video record training sessions without the prior written permission of Training by Francesca.

 

12.0 Data Protection

12.1 Client information will be collected and stored solely for the purpose of providing training services, administering bookings and maintaining business records.

12.2 Personal information will be processed in accordance with applicable UK data protection legislation and will not be shared with third parties except where required by law or where necessary to deliver the agreed services.

13.0 Force Majeure

13.1 Training by Francesca shall not be liable for any failure or delay in providing services where such delay is caused by circumstances beyond reasonable control, including but not limited to severe weather, illness, transport disruption, government restrictions, accidents or other unforeseen events.

 

14.0 Termination of Services

14.1 Training by Francesca reserves the right to terminate this Agreement immediately where the Client breaches these Terms and Conditions or where the training relationship can no longer continue safely, professionally or effectively.

15.0 Amendments

15.1 Training by Francesca reserves the right to amend these Terms and Conditions. Clients will be given at least 30 days' notice before any revised Terms take effect.

 

16.0 Governing Law

16.1 These Terms and Conditions shall be governed by and interpreted in accordance with the laws of England and Wales.

16.2 Any disputes arising from this Agreement shall be subject to the exclusive jurisdiction of the courts of England and Wales.
